Road Repair At Seascape

A meeting of the Seascape Association Board was held at President Tim Gallagher’s house to discuss the paving of the roads this year, 2019-2020. 

 

Tim confirmed a quorum shortly after 2:00 pm.  Board members present were Tim Gallagher, Charlie LoGuidice, Michelle Sax, John Honey, John Mannix, John Beigel, Russ Hazelton, and Ellen Clark. Jeannine Kelley conferenced called in and Greg Strakosch sent his vote by proxy in to Tim prior to the meeting.

 

Situation: The board agrees that we should do the roadwork, however the issue of how to handle the flooding at 101 and 104 Waterside Drive needs to be discussed.  The Association has the funds to do the roadwork. There is $50,362.16 in the road fund and we budgeted to add an additional $10,000.00 to the fund this year.  We propose to spend $50,000.00 this year. We have received approval by the membership by vote through email for the spending of $50,000.00 for the roads this year.

Jack Royle has developed the details of the roadwork, with the advice of the road committee, the Lawrence Lynch engineer, and Brian Murphy (the owner of the property at 101 Waterside Drive). We have not yet contacted the homeowners at 104 Waterside Drive.  We now have a name and address for the 104 property. 

We have modified the location of the starting point of the roadwork because of the upcoming construction at 59 Waterside.  At this time we are considering starting at the bump at A Beach. 

The road committee sent the owner of 101 Waterside Drive, Brian Murphy, a letter advising him that we will do the road work which will consist of a resurfacing of the road adding about 1½ inch of pavement and putting in a 1000 gallon drain on the side of the road near his home to help alleviate the accumulation of water in the dip in the road during average rain storms, however the drain will not eliminate it.  There will be excessive water in this location in a severe rainstorm no matter what is done because it is a low point. Brian is in agreement regarding the work and he was advised by the road committee per the opinion of the engineer from Lawrence Lynch that the flooding has been created by the construction of his home and the home at 104. 

 

Discussion:

Brian Murphy has been pushing for a solution to this issue for three years.  

We should send a letter to the owners of 104 just like we sent to Brian.

We do not want to own this problem.  The owners of 101 and 104 created this problem by their construction. The town cut a hole in the road to put the water in for 104, which added to the problem by lowering the height of the road in that area.  The DPW said they would not fix it. Now there is a pothole in the road.

 

The concern is that doing the roadwork will cause another problem; resurfacing will raise the road 1½ inch, which will increase the flow of water toward the 104 driveway.

 

Solution:

 

We propose to send a registered letter to 104, similar to the letter sent to 101, and have a face- to -face meeting with the 104 homeowners. We will courteously let them know the road paving will commence and inform them of the possibility of increased water flowing toward their property.  To help alleviate the flooding we are putting in the 1000-gallon drain, which will help in average rainstorms, but there will still be flooding in heavy rain. The 101 and104 homeowners are responsible for fixing their own drainage problems. It is not the responsibility of the Association. 

Tim will also request that the 104 homeowners pay their association dues.

We will confirm that Lawrence Lynch had an engineer decide the location of the drain on the 101 side of the road.

 

Decision:

  

1.  Who is in favor of paving the road from the bump at A beach through 101 and 104 to the Noonan gate, skipping the newly resurfaced sections, knowing that Tim is going to send a registered letter to 104 and have a face-to-face conversation with the 104 homeowners?

Vote: 8 yes and 1 abstaining

 

Additional agenda items regarding roadwork:

 

2.  Who is in favor of removing the berm at the circle near the courts? 

Vote:  9 yes -conditional

Conditional upon asking Lawrence Lynch if they concur with us that to remove the berm will help to change the flow of water away from the courts.  If it makes sense, then remove it.

 

3.  Who is in favor of adding curbing at the corner of Waterside and Anchorage at the Lodge home at 10 Waterside, in front of the Gimbrone home at 29 Anchorage, and in front of the Doherty home on 15 Anchorage?

Vote: 9 yes

 

4.  Stick the drains to see if they are full.  This has been done.

Additional business: Necessary to change the tennis courts lock.  Courts should be kept locked. All in agreement.
